Goods and Services

1.1

RCEL warrants that all goods promoted for sale on this site are of satisfactory quality. Specifications on this website of the goods to be sold, are not intended to be binding and are intended only to give a general description of the goods.

1.2

We reserve the right to: (i) make any changes in the specification necessary to comply with any applicable legal requirements; and (ii) change the specification published on this website provided this does not materially affect the quality or performance of the goods. In all other respects, and to the maximum extent permissible, RCEL makes no other warranties or promises about the goods, and any implied warranties are excluded.

Availability, prices and information

RCEL does not promise that goods are necessarily available, and all goods are offered for sale subject to availability. The price of the goods shall be the price listed on our website on the date of your order, inclusive of VAT. All prices displayed on the website are quoted in UK Pounds Sterling and must be paid in full, including delivery charges.

Ordering

We will treat each order for goods, confirmed when you click on the "[Proceed]" button on the Checkout Screen, as an offer by you to purchase the goods and services subject to these terms and conditions. You are responsible for ensuring the accuracy of your order and we shall supply you, subject to availability, with the quantity and specification of goods set out in your order. We shall confirm each order by e-mail but you would be advised to print out the Web Confirmation Screen before leaving this website. Our written confirmation shall be our acceptance of the contract between us.

Payment

You may pay using MasterCard, Visa credit card, or JCB, Delta or Switch debit card. RCEL does not offer any credit facilities, so we will not deliver goods to you if you do not pay for your order in full at the time of ordering. We use encryption software in an attempt to keep the information submitted by you secure. However, we cannot guarantee that any messages transmitted over the Internet, including those that include credit card details, will not be corrupted or intercepted by a third party. To the fullest extent permitted by law RCEL excludes all liability for the integrity of any messages sent to or received from RCEL.

Local Taxes

Some items sent abroad may be subject to local taxes. These taxes are at the discretion of Customs & Excise for that particular country and are beyond the control of Royal Collection Enterprises Limited.

Data Protection

6.1

RCEL is registered under, and will process your personal data in accordance with, the Data Protection Act 1998. By sending RCEL any messages you consent to the processing of your personal data by RCEL using databases and spreadsheets for the purpose of processing your request. This may involve RCEL disclosing your details to regulatory bodies and/or third parties.

From time to time we may also notify you by post, telephone, e-mail or fax of other goods and/or services offered by RCEL or others, if you have chosen to opt into our mailing list.

Delivery

Delivery shall be made to the delivery address supplied by you at the time of ordering. Any times quoted for delivery are approximate only and RCEL shall not be liable for any delay in delivery of the goods howsoever caused. Risk of damage to or loss of the goods shall pass to you at the time of delivery. Where an alternative delivery point is used according to instructions supplied by you at the time of ordering, ownership of the goods shall pass to you once the goods have been delivered, even if the goods have not been received by you in person.

Returns

RCEL wants you to be totally satisfied with our goods. Our warranty contained in term 1 above is subject to the following conditions: (i) the goods must be stored in appropriate conditions; if you do not store them in appropriate conditions we cannot be held responsible for faults or problems that arise as a result; (ii) any claim by you in respect of any shortages and/or defects in the goods must be notified to us by you within fourteen (14) days of the delivery date; failure to so notify us will, subject to cancellation (see below), deem you to have accepted the goods. Where you make a valid claim in respect of any shortages or defects and we are liable for the claim, we can at our option make up the shortages or replace the goods free of charge, or refund the price of the goods in question to you, but we shall have no further liability to you. If delivery is not refused and you do not notify RCEL accordingly, RCEL shall have no liability for any defects and you shall be bound to pay for the goods.

Cancellations

Cancellation of orders will only be accepted if an e-mail is received by RCEL (retail@royalcollection.org.uk) within fourteen (14) working days from receipt of the goods. The e-mail or written notice must contain your order number, name and address. RCEL will confirm any cancellation by e-mail and will repay you within 30 days from receipt of your cancellation without any further charge to you except the direct cost of returning the goods.

Limitation of Liability

The limit of our liability to you is the making up of any shortfall, replacement, refund of the price of the goods as provided for in terms 7 and 8. We are not responsible to you to any greater extent and in particular we are not liable to you for any indirect or consequential loss (including without limitation financial loss such as loss of profit, or otherwise) which you may incur for whatever reason, as a consequence of our failure to comply with these terms and conditions. This term does not operate to exclude or limit our liability in respect of death or personal injury caused by our negligence.

Choice of Law and Jurisdiction

These Terms shall be governed by and construed in accordance with English Law and agree to submit to the non-exclusive jurisdiction of the English courts.
